Surrogacy With New Legalities In India

Surrogacy in India has undergone significant legal transformations in recent years. The Surrogacy (Regulation) Act, 2021, introduced strict regulations to prevent commercial exploitation while ensuring ethical practices. The new law permits only altruistic surrogacy, where the surrogate mother receives no monetary compensation apart from medical expenses and insurance coverage.

Under the new law, only altruistic surrogacy is permitted, meaning surrogate mothers cannot receive financial compensation beyond medical expenses and insurance coverage. Additionally, eligibility criteria for intended parents have been defined, allowing only legally married Indian couples who meet specific medical conditions to opt for surrogacy. Single parents, live-in partners, and foreign nationals are restricted from accessing surrogacy services in India.

As India continues to refine its surrogacy laws, staying informed about the latest legal updates is crucial for those considering this path to parenthood.

surrogacy regulated

How is surrogacy regulated?

Surrogacy laws vary significantly across countries and even within different regions of the same country. The legal framework governing surrogacy typically depends on factors such as the type of surrogacy (gestational or traditional), the rights of the surrogate, and the intended parents' legal status.

In some countries, surrogacy is fully legal and regulated, ensuring clear guidelines for both intended parents and surrogates. These jurisdictions often require legal agreements to be in place before conception, outlining parental rights, financial arrangements, and medical responsibilities. For example, countries like the United States (on a state-by-state basis), Canada, and the United Kingdom allow surrogacy under specific legal conditions, often prioritizing the well-being of the surrogate and the child.

Altruistic surrogacy, where the surrogate is only compensated for medical expenses and reasonable costs, is legal in several countries, such as Canada and Australia. However, commercial surrogacy, where the surrogate receives additional financial compensation, is more controversial and restricted in many jurisdictions.

Our happy parents

“I have been married for more than five years. Earlier, we thought we could conceive later once we established a strong career and finances in the house. But, we never knew that this would become a stress for us. Even my husband told me to stop trying and asking for the baby. We lost hope completely. Then, we met Delhi Surrogacy, where we were given complete guidance. The doctors told us to try for the last time. This time also, we failed to conceive. We adopted the path of surrogacy, and today, we are the proud parents of a daughter.”

“We took help for the surrogacy procedure from Delhi Surrogacy. They helped us, from analysing the fertility level to giving wishes and money to our gestational carrier. Although the identity of the gestational carrier was maintained a secret from all of us, we sent her a gift card and our warm wishes to help us. It was a cost-effective procedure and overall a good experience, far better than we thought. Because we thought to not receive such facilities and amenities, and the doctors at Delhi Surrogacy proved us wrong.”

“I am a librarian. I wake up early in the morning, attend college, attend my library duties, and return home at around 6:00 pm. My husband comes home after 8:00 pm. With this hectic schedule, we never had the chance to conceive naturally. Time passed, and we became old to conceive through natural processes. I had various tests, and all of the fertility tests revealed my weakness in carrying a baby. Then, we took the help of Surrogacy. They helped us with every single step. We are now the parents of one son., who will be almost three months by October 2022.”
